Kyrgyz President signed law “About Right of Citizens to gather peacefully…”
President of Kyrgyzstan Mr. Kurmanbek Bakiev signed Law KR “Introducing additions and changes to the Law of KR “About Rights of Citizens to gather peacefully, without any weapons and to hold rallies and demonstrations freely”.
The President’s press service informed on August 6th and noticed that the acting Law “About Rights of Citizens to gather peacefully, without any weapon and to hold rallies and demonstrations freely” taking into account the decision of the Constitutional Court of KR from October 14, 2004 is applied with certain withdrawals that does not allow to fully realize rights of citizens to public actions and directs to certain legal blanks in part of regulating order while carrying out such actions.
“Signed Law meets the legal lacks existing in a Law in force. In particular, it is fixed, established by the Constitution of Kyrgyz Republic the notifying order of carrying out public actions (rallies, demonstrations and so on), prohibited conducting public actions in the places defined by the Law” – mentioned in the passage of the President’s press service.
Also establishing notifying order on organizing public actions is accompanied by rights of local authorities on disagreeing their conduct with the reference to the court about banning such actions or changing their terms of conduct in the case of infringing rights and freedom of other persons, public safety, protection of the constitutional system.
“Thus it is necessary to notice that by considering the Law in Parliament its separate positions gained diverse estimations among representatives of civil society, and a number of addresses were sent to the head of state” – informed the press service.
Taking into consideration that the General Declaration of Human Rights, International Pact on Civil and Political Rights and the Kyrgyz Constitution admit restrictions to freedom and human rights laws for maintaining freedom and rights of other person, public safety and order, importance of legal order regulations to conduct public actions considering maintenance of rights of all citizens in the country, the Kyrgyz President Mr. Bakiev signed Law of KR passed by the parliament “About introducing changes and additions to the Law of KR “About Rights of citizens to gather peacefully, without any weapons, to hold rallies and demonstrations freely” – explained the press-service of the President.
Simultaneously, considering remarks and offers of the Government, the Akyikatchy (Ombudsman) KR and number of addresses from public organizations, OSCE with important mission head of state directed the following comments and remarks and addresses to Kyrgyz Parliament for further consideration at established order.
