Problems of torture apply was discussed
The problems of torture apply in Kyrgyzstan, culturalogical and other approaches to problems of torture solution, a role of lawyers in the prevention were discussed on June 17 in Bishkek by state representatives and public organizations at round table “Fight against tortures in Kyrgyzstan: situation analysis and joint efforts”.
As “AKIpress” reported, according to round table participants fact that in Kyrgyzstan there was not any criminal case opened under article 305-1 "Torture" Criminal code - does not mean, that tortures have no place in Ê R. On the contrary, in human rights activists' opinion, it means insufficient struggle against this phenomenon.
“Tortures is a heritage of Bolshevism, and now we have only rehabilitated Bolshevism” - deputy of Jogorku Kenesh (Parliament of KR) Zainidin Kurmanov said. According to him “Fight against tortures is taken to joining of the next Convention in Kyrgyzstan ”. Parliament members see the solution of the issues in trainings, excluding violence.
Position of SMPC in fight against tortures was presented by the chief of the given establishment Ernest Isaev. “I responsibly declare that in criminal and executive system KR there is no place to tortures and cruel treatment with the prisoners” - he emphasized. As he said, the rights of the convicts are broken in another action: “By reasons of shortage of means we dress prisoners only on 20 % and we feed on 50 %”- E. Isaev stated.
Human rights defenders, in their turn pointed that beatings and tortures concerning arrested persons, are applied basically at detention centers while interrogating. “Conditions in jails may also be count as tortures”- head of Monitoring Department of the Ombudsman Ikram Mameshov considers. As he said, it is necessary to put investigation under the civil control.
Decisive part in prevention of tortures A. Abdirasulova sees the role of the lawyer. However, as she said, “frequently lawyers on duty at Rayon Department of Interior Affairs opposite, promote human rights infringements by signing ready protocols of inspectors”. “We do not know how many state and private lawyers are in each rayon of Kyrgyzstan , so we are going to require the number from the Ministry of Justice” – she informed.
Participants of "a round table» have agreed in opinion, that torture is the latent, latent crime which it is very difficult to prove, however with this phenomenon it is possible and it is necessary to struggle. Thus important role in struggle against tortures participants of action consider joint actions of state bodies and public organizations.
