Osh Oblast Court stood judgment of the City Court on financial and moral damage recovery from city education municipal

On June 27 Board of Osh Oblast Court on civil cases stood the judgment of Osh City Court on collecting from Osh City Education Municipal financial and moral damage recovery in more than 400 thousand soms.

107355 soms of material and 300000 soms of moral damage recovery have been collected by court as a result of considering statement of claim by Anna Shaburova living in Osh . Her son being in kindergarten, which is referred to city education management, was shot by a toy gun in his eye by his groupmate. As a result of it, by the conclusion of judicial and medical experts, the child was injured terribly.

In the appeal case Osh city education municipal asked the oblast court to rescind the city court decision, considering it as unreasonable, and to pass the new decision on refusal in satisfying A. Shavurova's claim.

In particular, municipal government doubted medical examination conclusion on developing a posttraumatic cataract in the child and stated that incident happened “not in purpose, but during the game between children”.

The oblast court board after having considered materials of cases and having heard the sides, decided to leave the city court decision without any changes.
